These Terms & Conditions govern your use of the 389 Konvene mobile applications (including the attendee app and the scan app) operated by 389 Group Ltd (“we”, “us”, or “our”). By downloading, installing, or using the apps, you agree to these terms.
Separate terms may apply to the 389 Xperience marketing website and to commercial agreements with event organisers. If there is a conflict between these app terms and a signed organiser agreement, the organiser agreement prevails for that organiser’s use of the service.
The service
389 Konvene provides tools for closed-event management, including registration, badging, check-in, scanning, and related features configured by event organisers. Features available to you depend on the event and your role (for example attendee or scan operator).
Eligibility and accounts
You must use the apps only for lawful purposes and only in connection with events you are authorised to attend or operate. You are responsible for safeguarding any login credentials, devices, and access tokens issued to you, and for activity that occurs under your account or device.
Organiser content and instructions
Event organisers control event configuration, attendee lists, and on-site procedures. You agree to follow lawful instructions from the organiser for the event you are attending or staffing. We are not responsible for organiser decisions, event content, or disputes between attendees and organisers.
Acceptable use
You must not:
- Attempt unauthorised access to events, data, accounts, or systems
- Interfere with scanning, check-in, or other event operations
- Reverse engineer, scrape, or misuse the apps except as permitted by law
- Upload unlawful, harmful, or infringing content
- Use the apps to harass others or violate applicable law
Device permissions
Some features require device permissions (for example camera access for QR scanning). You can refuse or revoke permissions in your device settings, but some features may then be unavailable.
Intellectual property
The apps, branding, and underlying software are owned by 389 Group Ltd or its licensors. These terms do not transfer ownership to you. You receive a limited, non-exclusive, non-transferable licence to use the apps for their intended event purposes.
Third-party stores and services
If you download the apps from Google Play or another store, that store’s terms may also apply. Payment, refunds, and store account issues are handled under those store terms unless we state otherwise in a commercial agreement.
Availability and changes
We may update, suspend, or discontinue app features to improve security, performance, or the product. We do not guarantee uninterrupted availability. You should keep the apps updated to the latest version we distribute.
Disclaimer
The apps are provided on an “as is” and “as available” basis to the fullest extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where such disclaimers are not allowed.
Limitation of liability
To the fullest extent permitted by law, 389 Group Ltd is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the apps. Our total liability for any claim relating to the apps is limited to the greater of (a) the fees you paid us for the Konvene service in the twelve months before the claim, or (b) zero if you use the apps only as an invited attendee or free end user. Nothing in these terms excludes liability that cannot be excluded under applicable law.
Termination
We may suspend or terminate access if you breach these terms or if an organiser or security requirement requires it. You may stop using the apps at any time by uninstalling them.
Governing law
These terms are governed by the laws of Malawi, without regard to conflict-of-law rules, unless mandatory consumer protections in your country require otherwise.
Changes to these terms
We may update these Terms & Conditions from time to time. The “Last updated” date will change when we do. Continued use of the apps after an update constitutes acceptance of the revised terms where permitted by law.
